1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of DVR Time Traveler (DVRTT) ("the App"), a mobile application developed by SDTech © 1236585 ("we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of the App.

2. Description of Service

DVR Time Traveler is a specialized calculator tool designed for law enforcement professionals to:

• Calculate time differences between real date/time and DVR date/time
• Calculate target DVR date/time based on real incident date/time
• Calculate retention dates based on the earliest recorded DVR date
• Generate timestamped reports with document authentication for legal investigations
• Store calculation history locally on the user's device
• Export reports as PDF documents
• Email reports directly from the device

3. Intended Use and Eligibility

3.1 Professional Use

This App is designed specifically for:

• Law enforcement officers
• Legal professionals
• Security personnel
• Investigators working on cases requiring DVR evidence preservation

3.2 Age Requirement

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

3.3 Geographic Restrictions

The App is available worldwide, but retention date calculations are based on general legal principles. You are responsible for ensuring compliance with local laws and regulations in your jurisdiction.

4. License and Restrictions

4.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device for lawful professional purposes.

4.2 Restrictions

You agree NOT to:

• Reverse engineer - Decompile, disassemble, or attempt to derive source code
• Modify or redistribute - Alter, copy, distribute, or create derivative works
• Commercial resale - Sell, rent, lease, or sublicense the App
• Unauthorized access - Bypass security features or access restricted areas
• Misrepresent - Falsely claim affiliation with SDTech or the App
• Illegal use - Use the App for any unlawful purpose

5. User Responsibilities

5.1 Accuracy of Data

You are solely responsible for:

• The accuracy of date/time inputs you enter
• Ensuring your device time is accurate (synchronized with network time when possible)
• Verifying calculated retention dates against local laws
• Ensuring reports generated are used appropriately in legal proceedings
• Protecting sensitive case information stored on your device

5.2 Device Security

You must:

• Secure your device with a passcode, PIN, or biometric lock
• Keep your device operating system updated
• Avoid jailbreaking (iOS) or rooting (Android) your device
• Protect PDF reports you generate from unauthorized access
• Immediately report any security breach or unauthorized access

5.3 Compliance with Laws

You are responsible for ensuring your use of the App complies with:

• Federal, state, and local laws
• Evidence preservation regulations
• Chain of custody requirements
• Privacy and data protection laws (GDPR, CCPA, etc.)
• Department policies and procedures

6. Disclaimers and Limitations

6.1 No Legal Advice

DVR Time Traveler is a calculation tool, NOT a legal advisor.

• The App does NOT provide legal advice or interpretation
• Calculations are based on general principles and may not reflect specific jurisdictional requirements
• You should consult with legal counsel for case-specific guidance
• We are NOT responsible for legal outcomes based on app usage

6.2 "AS IS" and "AS AVAILABLE" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability - Fitness for a particular purpose
• Accuracy - Correctness of calculations or generated reports
• Reliability - Uninterrupted or error-free operation
• Security - Complete protection against data breaches
• Compatibility - Function on all devices or OS versions

6.3 Calculation Accuracy

While we strive for accuracy, we do NOT guarantee:

• Absolute correctness of all time difference calculations
• Absolute correctness of target DVR date/time calculations
• Absolute correctness of retention date calculations
• Accuracy of device clock time (if device is not synchronized with network time)
• Compliance with all jurisdictional variations
• Admissibility of generated reports in court
• Acceptance by judges, attorneys, or legal entities

6.4 No Liability for User Error

We are NOT liable for:

• Incorrect data entry by users
• Errors in time difference calculations due to incorrect inputs
• Wrong target DVR date/time due to input errors
• Missed deadlines due to incorrect retention date calculations
• Lost or overwritten DVR evidence
• Rejected warrants or subpoenas
• Legal penalties resulting from app usage

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

SDTECH, ITS DEVELOPERS, AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:

• Direct damages - Loss of data, evidence, or case information
• Indirect damages - Lost investigations, failed prosecutions, or dismissed cases
• Consequential damages - Professional sanctions, disciplinary actions, or termination
• Incidental damages - Device damage, data corruption, or security breaches
• Punitive damages - Fines, penalties, or legal judgments

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

7.1 Maximum Liability Cap

In no event shall our total liability exceed the amount you paid for the App (which is $0 for free versions).

8. Indemnification

You agree to indemnify, defend, and hold harmless SDTech and its affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your breach of applicable laws or regulations
• Reports generated and submitted by you
• Actions taken based on App calculations

9. Updates and Modifications

9.1 App Updates

We may release updates to improve functionality, fix bugs, or enhance security. You are responsible for:

• Installing updates promptly
• Checking for new versions regularly
• Understanding that older versions may have unpatched vulnerabilities

9.2 Terms Changes

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms with a new "Last Updated" date.

Continued use of the App after changes constitutes acceptance of the updated Terms.

10. Termination

10.1 Termination by You

You may terminate this agreement at any time by:

• Uninstalling the App from your device
• Deleting all associated data
• Ceasing all use of the App

10.2 Termination by Us

We reserve the right to discontinue the App or revoke your license at any time for:

• Violation of these Terms
• Illegal or fraudulent activity
• Suspected security threats
• Any reason, with or without notice

10.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must delete the App and all associated data
• Disclaimers and limitations of liability survive termination

11. Intellectual Property

11.1 Ownership

All intellectual property rights in the App, including but not limited to:

• Source code and algorithms
• Design, layout, and user interface
• Logos, trademarks, and branding
• Documentation and help content

...are owned by SDTech and protected by copyright, trademark, and other intellectual property laws.

11.2 User-Generated Content

You retain ownership of all case data, reports, and information you create using the App. We do NOT claim any rights to your content.

12. Third-Party Services

The App may interact with your device's native services:

• Email clients - For sending reports (Mail, Gmail, Outlook, etc.)
• File storage - For saving PDF reports
• Operating system - iOS/Android APIs

We are NOT responsible for the functionality, privacy practices, or security of these third-party services. Refer to their respective terms and policies.

13. Export Control

The App may be subject to export control laws. You agree NOT to:

• Export or re-export the App to prohibited countries
• Use the App in violation of U.S. export laws
• Transfer the App to sanctioned entities or individuals

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles.

14.2 Amicable Resolution

In the event of a dispute, we encourage amicable resolution first. Please contact us at [email protected] to attempt to resolve the matter amicably.

14.3 Jurisdiction

For disputes that cannot be resolved amicably, the courts of the Province of Quebec, Canada, shall have exclusive jurisdiction, except where prohibited by local law.

14.4 Local Legal Rights

Nothing in these Terms affects your statutory legal rights in your jurisdiction that cannot be contractually waived.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SDTech regarding the App and supersede all prior agreements.

• Safeguards: Standard Contractual Clauses (SCCs), sendDefaultPii: false
• Legal Basis: Legitimate interest (Article 6.1.f)

17.5 Exercising Your Rights

To exercise your GDPR rights:

• No Fee: All requests processed free of charge

Note: Due to local-only storage, breach risk is minimal. Most risks involve device loss/theft.

19. Acknowledgment and Acceptance
